Terms & Conditions of Purchase: 
 
Swinkeygolf Inc. ("Swinkeygolf Inc.", "we", "our" or "us"), owns and operates the Swinkeygolf website. These terms and conditions constitute a contract between you, the purchaser and us, Swinkeygolf Inc. and govern the use of www.swinkeygolf.com and the transactions between you and us. 
 
These terms are subject to change. Please refer to www.swinkeygolf.com for any changes.
 
Terms of Purchase Price:
 
Swinkeygolf Inc. product prices are listed at the website. We reserve the right to modify and/or change our product prices, shipping & handling fees and/or any other charges at any time. Our product prices, shipping & handling and any other charges in your order will be charged upon receipt of order.
 
Return and Refund Policy:
 
Swinkeygolf Inc. is committed to customer satisfaction. If, for any reason, you are not satisfied with your Swinkey, you can call us to get a return authorization number (RA#) within 30 days of the purchase date. Products without an RA# maybe refused. In most cases, we will provide a full refund on undamaged returns less a 15% re-stocking fee and return shipping and handling. All returns are subject to evaluation before issuing a credit. Please keep the shipment packaging for 30 days to re-use for any possible returns.
 
Product Availability, Delivery and Transfer of Title:
 
Swinkeygolf Inc. has limited control of product availability and therefore cannot guarantee availability of an ordered product. If we are unable to deliver an ordered product due insufficient inventory, someone will notify you and you make you aware of the two options available to you: 1) request that we deliver the product upon availability, in which case you will be charged the full amount of purchase at that time; or 2) cancel your current order and request for NO delivery of the product, in which case you will not be charged. Swinkeygolf Inc. is not held responsible for, and disclaim any responsibility for, any damage or suffering due to unavailability of our product of which you ordered.
 
Swinkeygolf Inc. will deliver all products ordered upon full receipt of payment for the entire purchase. All products will be delivered to the address provided to us at the time of order unless otherwise specified. Our products will be delivered in a safe and timely manner, however, we will not be held responsible for and disclaim any responsibility for issues beyond our control including, but not limited too, acts of God, transportation, mechanical or system failures, interruptions, weather, strikes or other business issues, acts of public authorities including but not limited to; customs, health officials that may delay or prevent shipment. The title of your ordered products passes to you and therefore you become the owner of them at the moment the shipping carrier (UPS) passes them to you. With the exception of anything else provided herein, at the moment of transfer you assume all risk associated with our products and we are no longer liable for lost, damaged or destructed goods.
 
The delivery of our products is subject to the rules and regulations of our carrier (UPS). If you are unreachable or absent from the designated delivery address at the moment of delivery, it is your sole responsibility to recover/attain the products in accordance to the rules and stipulations of the shipping company (UPS) upon their attempt to deliver your ordered products.

Swinkeygolf Inc., the Swinkey design, logo, name and all content with publications, website or related websites are protected under Patent PCT/IB 2009052591-26762. Through access and sale of our store and products you hereby agree not to reproduce, duplicate, copy, sell, re-sell, or exploit for any commercial purposes whatsoever any of our products and/or services.
